Comunicado

Nos últimos dias a comunicação social tem dado a notícia de que autoridade timorense não judicial teria mandado libertar da prisão Maternus Berek que estava preso por decisão judicial; havia quem perguntasse na comunicação social por que razão o Presidente do Tribunal de Recurso não tomou nenhuma medida sobre esse facto.

Sobre a questão, como Presidente do Tribunal de Recurso e do Conselho Superior da Magistratura Judicial, gostaria de esclarecer o seguinte:

De acordo com as informações que consegui reunir, o juíz do Tribunal Distrital de Suai ordenou que Maternus Berek aguardasse em prisão o julgamento; contra o arguido pendia acusacao de ter cometido crimes graves em 1999; o tribunal tinha emitido ha muito mandados de detenção do arguido para ser julgado. A libertação referida pela comunicação social, a ter acontecido, não foi ordenada por decisão judicial.

Segundo a nossa lei e a nossa Constituição, só o juíz é que pode ordenar que alguém seja colocado em prisão ou libertado da cadeia. Qualquer autoridade não judicial não tem poderes para libertar ou mandar libertar da cadeia quem tenha sido colocado em prisão por ordem judicial.

Segundo o artigo 245°, n. 1, do Código Penal timorense, quem, por meios ilegais, libertar ou por qualquer meio auxiliar a evasão de pessoa legalmente privada da liberdade e punida com prisão de 2 a 6 anos.

A nossa Constituição define Timór-Leste como Estado de direito democrático – Estado que se rege segundo a lei e os princípios democráticos.

A nossa Constituição atribui a cada órgão de soberania o conjunto de poderes que ele pode exercer e não permite que um órgão de soberania exerça competências atribuídas a outro órgão.

Nenhum órgão de soberania não judicial tem poderes pare libertar da prisão quem está preso por ordem judicial, mesmo que por razões políticas.

No Estado de direito democrático todos temos que cumprir a lei.

Quando não se utiliza o mecanismo legal pare resolver os problemas eles tenderão a avolumar-se. A crise de 2006 foi um bom exemplo disso.

A lei é a melhor garantia da estabilidade; a violação da lei é fonte de conflitos.

Por isso, o Conselho Superior da Magistratura Judicial e o Presidente do Tribunal de Recurso acompanham com atenção o processo em que é arguido Maternus Berek. O Conselho Superior da Magistratura Judicial na sue reunião de 04.09:2009 encarregou a sua lnspectora Judicial de fazer as averiguações necessárias. A verificar-se que houve libertação ilegál de arguido preso por decisão judicial, sera dado conhecimento do facto as autoridades competentes para desencadear a acção penal e discipliner correspondente.

Communique

In recent days the media has transmitted news that Timorese non-judicial authorities ordered the release from prison of suspect Maternus Bere who was put in prison by a Judge’s order; some people are asking in the media why the President of the Court of Appeal has not taken any measures regarding this event.

On this issue, as the President of the Court of Appeal and the Superior Council of the Judiciary, I would like to make the following clarification:

According to the information that I have been able to gather, the judge of the Suai District Court ordered to Maternus Bere to prison to await his trial; against the accused were pending indictments that he committed serious crimes in 1999; the court had some time ago issued arrest warrants for the accused to be brought to court. 

The release referred to in the media as having occurred, was not ordered by a court decision.

Under our law and our Constitution, only a judge can order that someone who has been placed in prison be released from prison. No non-judicial authority has any power to release or order the release from prison someone whom a judge has sent to prison.

According to section 245, subsection 1 of the Timor-Leste Criminal Code, whoever, through illegal means, frees or through other means helps in the freeing and evasion of any legally detained person is punishable by imprisonment from 2 to 6 years.

Our Constitution defines Timor-Leste as a Democratic State under the Rule of Law ­ a state that is governed according to the law and the rules of democracy.

Our Constitution defines for each sovereign organ a set of powers that it can exercise and does not allow any sovereign organ to exercise powers assigned to other organs.

No non-judicial sovereign organ has the power to release a prisoner who has been imprisoned pursuant to a court order, not even for political reasons.

In a Democratic State under the Rule of Law we all have to obey the law.

When we don’t use legal means to resolve problems they may grow larger.  The 2006 crisis was a good example of this.

The law is the best guarantor of stability, violating the law leads to conflicts.

Because of this, the Superior Council for the Judiciary and the President of the Court of Appeal are attentively accompanying the process in the case of the suspect Maternus Bere. The Superior Council for the Judiciary, during its meeting on 4 September 2009, directed the Judicial Inspector to make the necessary inquiries.  Upon verification that there has indeed been an illegal release of the suspect who was imprisoned by a court order, the appropriate authorities will be notified of that fact to launch the correspondent legal and disciplinary action.
